According to the owners of the dairy, the MDA threatened to arrest the co-op owner, Jenny Samuelson, for “selling food without a license.” However, the farm is a co-op, where people must buy shares. The MDA, however, said that the co-op contracts were invalid, and therefore, instead of being shared, the food was being sold. Because co-op members had paid for their shares, technically the MDA stole food that belonged not just to the Golimbieski family, but to every single member of that co-op.

Obamacare appears to be headed back to the U.S. Supreme Court. On Tuesday the U.S. Court of Appeals for the D.C. Circuit and the U.S. Court of Appeals for the 4th Circuit issued dueling opinions on the legality of an I.R.S. rule which provides tax credits to individuals who purchased their health insurance from federally run health care exchanges.
The controversy here stems from the fact that the text of the 2010 Patient Protection and Affordable Care Act limits such tax credits to individuals who purchased their insurance from an "exchange established by a State." In other words, as the legal scholar Richard Epstein summarized, "Do the words an 'exchange established by a State' cover an exchange that is established by the federal government 'on behalf of a state'?" The D.C. Circuit held that those words do not cover the federally run exchanges while the 4th Circuit held that they do. Thus we have a clear split among the federal circuits on a legal question of undeniable national importance. Translation: The Supreme Court is likely to get involved.

A California charter school chain threatened by the Los Angeles United School District (LAUSD) with closing may have two of its schools saved in court, as concurrently parents protested in front of a downtown Los Angeles courthouse.

Standing near a crowd of protesters chanting, “Save our school,” near a downtown Los Angeles courthouse, Alfredo Rubalcavna, a principal of the Magnolia Science academies,told KCAL Los Angeles, “People believe that LAUSD did not follow the legal process required of closing down a charter school; we certainly don’t agree with their decision at all, and from a legal standpoint, they did not follow the law.” He said he walked out of court “positive” science academy 7 in Van Nuys and academy 6 in Los Angeles would not be closed and would open on schedule, Aug. 12.
Meanwhile, Los Angeles Superior Court Judge Luis Lavin, who said he would issue a final decision on Friday, commented that it did not seem “right to me or very fair” that the school district employees could close the schools without making public the data that supported their claims of fiscal problems with them. Lavin said, “I certainly think the school board would like to have some oversight. I think it would be an abdication of their duties to simply whole-sale delegate their authority to an investigator or staff.”
The Los Angeles Times reported that LAUSD told the Magnolia Educational and Research Foundation in June that two schools it supported, one in Northridge and one in the Palms area of Los Angeles, would have to be closed because of some financial problems that were found in an audit.
Magnolia denied the charges, and sued the district to keep the schools open. Although the district allows that the schools are doing well academically, Jose Cole-Gutierrez, the district’s charter school division director, wrote a June 27 letter to the foundation stating the audit found the money issues “rise to a level of severity that seriously questions [Magnolia's] ability to operate the school let alone support itself.”
The audit was executed by an outside firm for the district’s Office of Inspector General, and Cole-Gutierrez said it showed that the foundation was $1.66 million over its budget, and owed $2.8 million to the schools, thus considered insolvent by the federal government. The audit also stated that the Palms academy was insolvent.
The audit also stated that there was evidence of fiscal mismanagement, abuse of debit cards by the principals, questionable payments made for immigration fees and services, and unnecessary academic and business services farmed out to a related nonprofit organization.
Yet Inspector General Ken Bramlett wrote a June 23 confidential letter to the Board of Education and L.A. schools Supt. John Deasy, in which he argued, according to the LA Times, that “no clear evidence of fraud has been disclosed.” Bramlett said the June 30 deadline for the audit had left “significant open areas of inquiry that still must be pursued … to determine their propriety.” Deasy only asserted that the investigation had applied to all eight Magnolia campuses.
The Magnolia Foundation’s chief executive officer, Mehmet Argin, responded on July 3 that the foundation had $4.8 million in net assets in 2013, and the foundation believed that those assets would ascend to more than $7 million by June 2014. He said the other charges of the audit were false.
The district’s contract attorney, Sue Ann Evans, had told Lavin that school board members gave district employees the authority to close the school if the audit showed any improprieties. But Lavin responded that he wanted to know what Superintendent John Deasy meant when he threatened board members at the March 4 meeting that if there were any improprieties at all, “it should come back for revocation, period.”
The LAUSD will not show the audit to Magnolia, and when asked by the Los Angeles Daily News as a public records act request it also rebuffed the request. Magnolia’s lawyer, Lisa Corr, wanted to know whether the privacy of the audit was a way for the LAUSD to flout public records laws.
The audit had been requested by LAUSD’s charter school division of the school’s Office of the Inspector General. The Inspector General’s office then farmed out the audit to a private firm. Corr stated according to the Daily News, “By using the Office of Inspector General I think you can circumvent the public records requirement.”
Evans responded that the audits are only made available with permission of the Office of Inspector General, adding that there is a “potential” criminal investigation. But the Los Angeles District Attorney’s office said there is no record of a complaint regarding Magnolia.

Planned Parenthood abortion clinics have come under fire countless times over the years for not reporting cases of statutory rape to authorities as required by state law. Earlier this year, in Arizona, officials says the abortion giant failed again to provide the proper report to authorities about a victim of a young man who is a serial rapist.
Not only did Planned Parenthood intentionally fail to report the rape but, in so doing, it allowed the rapist to rape as many as 18 or more teenage girls, authorities say, making it so the abortion company is partially responsible for victimizing them as well.

The trial of one of Venezuela's main opposition leaders, Leopoldo Lopez, has begun in the capital, Caracas.
He is accused of inciting violence during anti-government demonstrations.
Mr Lopez has been in custody since 18 February, when he handed himself in to the authorities. He denies all the charges.
Hundreds of thousands of people took to the streets of Venezuela earlier this year in months of protests against rising inflation and crime.
Mr Lopez, 43, has accused the government of President Nicolas Maduro of jailing Venezuelans for seeking democratic change.
Other opposition activists detained during the protests have also appeared in court in Caracas..
There is heavy police presence and road blocks near the Justice Palace.
But hundreds of supporters, including Mr Lopez's wife, Lilian Tintori, and parents, have gathered outside the court to call for his release.
'Failed socialist policies'

The street protests began in late January, in the western states of Tachira and Merida.
Opposition leaders seized the moment and called for a big anti-government march in Caracas a few weeks later, on 12 February.

Mr Lopez was among the most active leaders. He founded a movement to advocate a change of government using the hashtag #LaSalida, which in Spanish means both "the exit" and "the solution".
The government urged its supporters to take to the streets in the same day, in a rival march. Three people died in incidents at the end of the marches.
The authorities accused Mr Lopez of inciting violence and encouraging demonstrators to vandalize government buildings.
He went into hiding after being charged, but announced he was going to hand himself in during an opposition demonstration through the streets of Caracas on 18 February.
Mr Lopez has been in jail ever since. He has been an outspoken critic of Mr. Maduro and his predecessor, Hugo Chavez, who died in March 2013.
Like other opposition leaders, he blames 15 years of failed socialist policies for the economic decline of Venezuela, a major oil producer.
Mr Lopez faces a maximum sentence of 10 years in jail if convicted.
A total of 42 people, both supporters and opponents of the government, have died in the protest-related violence.
More than 300 demonstrators were detained, but most of them have now been released.

California Governor Jerry Brown just signed a new law that would reduce the number of legal immigrants eligible for deportation after being convicted of a misdemeanor, even crimes such as child molestation and identity theft.

SB 1310 will cut the maximum possible sentence for a misdemeanor by one day, a move that would halt deportation for immigrants convicted of the offense.
Federal law maintains that immigrants sentenced to 365 days in jail are eligible for deportation. The new law will set California's maximum sentence at 364 days, making sure no immigrant is ever deported under the federal rule.

The Obama administration has quietly approved a substantial expansion of the terrorist watchlist system, authorizing a secret process that requires neither “concrete facts” nor “irrefutable evidence” to designate an American or foreigner as a terrorist, according to a key government document obtained by The Intercept.
The “March 2013 Watchlisting Guidance,” a 166-page document issued last year by the National Counterterrorism Center, spells out the government’s secret rules for putting individuals on its main terrorist database, as well as the no fly list and the selectee list, which triggers enhanced screening at airports and border crossings. The new guidelines allow individuals to be designated as representatives of terror organizations without any evidence they are actually connected to such organizations, and it gives a single White House official the unilateral authority to place “entire categories” of people the government is tracking onto the no fly and selectee lists. It broadens the authority of government officials to “nominate” people to the watchlists based on what is vaguely described as “fragmentary information.” It also allows for dead people to be watchlisted.
Over the years, the Obama and Bush Administrations have fiercely resisted disclosing the criteria for placing names on the databases—though the guidelines are officially labeled as unclassified. In May, Attorney General Eric Holder even invoked the state secrets privilege to prevent watchlisting guidelines from being disclosed in litigation launched by an American who was on the no fly list. In an affidavit, Holder called them a “clear roadmap” to the government’s terrorist-tracking apparatus, adding: “The Watchlisting Guidance, although unclassified, contains national security information that, if disclosed … could cause significant harm to national security.”

The U.S. Court of Appeals for the D.C. Circuit, often described as the second-highest court in the land, could rule on Halbig v. Burwell as early as tomorrow. Halbig is one of four lawsuits challenging the legality of the health-insurance subsidies the IRS is dispensing in the 36 states that did not establish a health-insurance Exchange under the Patient Protection and Affordable Care Act, or “ObamaCare,” and thus have Exchanges established by the federal government. Though the PPACA repeatedly states those subsidies are available only “through an Exchange established by the State,” and there are indications IRS officials knew they did not have the authority to issue subsidies through federal Exchanges, the IRS is dispensing billions of dollars of taxpayer subsidies through federal Exchanges anyway. The Halbig plaintiffs are employers and individuals from six federal-Exchange states who are being injured by the IRS’s actions because those illegal subsidies trigger taxes against them under the PPACA’s employer and individual mandates. The plaintiffs want relief from those illegal taxes, and the only way to get it is to ask federal courts to put a stop to the illegal subsidies. Recent media coverage of Halbig, driven by one-sided blog posts from the consultant group Avalere Health and the left-leaning Urban Institute and Robert Wood Johnson Foundation, has misrepresented the impact of a potential ruling for the plaintiffs by ignoring three crucial facts: (1) a victory for theHalbig plaintiffs would increase no one’s premiums, (2) if federal-Exchange enrollees lose subsidies, it is because those subsidies are, and always were, illegal, and (3) the winners under such a ruling would outnumber the losers by more than ten to one.

Levy tells me about 2,000 interns signed up for the free event, and the line winded down the block from Broadway Studios, which had a capacity of about 500. He said no interns were turned away, and they let about 600 in “night club style,” allowing one to leave when one entered.
I’m an intern myself in San Francisco, and this was only my second intern networking event. There’s an immediate awkwardness when you first walk into these events, and at first this one did feel like a crowded night club — with fewer beers and more Yale and Google t-shirts.
It was impossible to navigate the room where recruiters from Eventbrite, Indiegogo and other event sponsors schmoozed with interns and hungry college students lined up for free hot dogs and pasta. At age 20 I was on the older end of the guests — another intern pointed out a boy who was around 15 interning at Google, and a 16-year-old asked a question about a startup he has already launched during the Q&A.
When registering for the event, interns filled out an extensive survey. Only 40 percent of those surveyed said they wouldn’t drop out of school to work on a startup, 40 percent said they would consider it and 20 percent said maybe.
More than half of the interns at the event were CS majors, and about 80 percent studied something engineering related.
About 1/3 of those who registered were female. During a Q&A with the speakers, one young woman stepped up to the mic and asked the panel for any advice they would give a woman looking to break into the industry. Only two of the speakers at the event were female, and Swisher was the only woman on this Q&A panel.
“It’s a sausage fest out there ladies, and not in a good way,” Swisher said.
This became abundantly clear a few minutes later when the panel moved to Michael Callahan, Levy’s co-founder at One, who said evolutionarily, we tend to encourage boys and discourage girls.
“I think all we have to do to change the industry as a whole is to just be sexless, just absolutely ignore the fact that you’re a woman and compete just as hard as the men,” Callahan said.

Here is an update on the case of Debra Harrell, the South Carolina mom jailed for letting her 9-year-old play in a popular park unsupervised (you read it here first), while she worked at McDonald's.
Harrell was jailed for one night. Her daughter was kept in state custody for a whopping 17 days.
That's right: Seventeen days in custody, all because her mother wanted to let her play outside rather than sit inside a stuffy restaurant all day.

Harrell has also lost her McDonald's job. Wonkette managed to reach McDonald's, which told her that responding to any inquiries about this situation would be "inappropriate."
Robert Phillips, a trial lawyer, has taken Harrell's case a pro bono. And someone (not me) set up a "Support Debra Harrell" fund that currently has about $30,000 in it. Here it is.
At the moment, her case is pending. In other words, no justice for this mother—yet.

The Obama administration will continue handing out Obamacare subsidies to federal exchange customers despite a federal court’s ruling Tuesday that the subsidies are illegal.
A D.C. But the White House said in response that it will continue handing out the billions of taxpayer dollars in subsidies. White House press secretary Josh Earnest said that while the case continues to be battled out in the courts, the administration will continue to dole out billions in tax credits to federally-run exchange customers.
“It’s important for people all across the country to understand that this ruling does not have any practical impact on their ability to continue to receive tax credits right now,” Earnest said in a press briefing Tuesday.
A three-judge panel issued the ruling Tuesday, concluding 2-1 that the federal subsidies are illegal. The Department of Justice is seeking an en banc ruling from the appeals court, which would require all judges in the court to rule on the case. Eleven judges on the court would hear the case: seven Democrats and four Republicans.
That decision will likely also be appealed to the Supreme Court.

It’s already clear what the first big dispute in the new European Parliament is going to be. Should the EU sign a free trade agreement with the United States and, if so, on what terms?
A number of MEPs distrust free trade in their bones. Almost all the communists, with their fascist cousins, will vote against a commercial deal with the US, regardless of the content. Several MEPs in other groups are also suspicious. Some want the deal to be conditional on environmental standards or on social regulation. Others drag in wholly unrelated issues, such as data sharing or foreign policy. Still others dislike the clauses that allow companies to override national governments when those governments are in breach of the agreement. Add the outright anti-capitalists to the qualified protectionists and you have an anti-TTIP majority. (TTIP, the Transatlantic Trade and Investment Partnership, is the official name.)
That’s not to say that there will be no deal. In Washington, as in Brussels, politicians hate admitting to failure, so something called TTIP will almost certainly be signed. The trouble is that, by the time it has been hacked at by protectionists on both sides of the Atlantic, it will be a maimed, anaemic thing. Indeed, the slicing had begun even before the talks. France, for example, made clear that films were not on the table, which may not sound that big a deal until you learn that Hollywood is the United States’ third most valuable export sector.
Both sides have made optimistic claims about how much TTIP will boost their GDP. And, without question, a wholly unrestricted North Atlantic commercial zone would bring enormous benefits. But that doesn’t seem likely to be the outcome. At best, trade liberalisation will be modest and limited; at worst, we could end up with a more regulated market, as vested interests take the most burdensome standards from the US and the EU and combine them.
It’s a missed opportunity from the United Kingdom’s point of view. Outside the EU, we’d have negotiated a properly open bilateral deal with the United States years ago. As members, we’re obliged to uphold a relatively protectionist EU commercial policy for the sake of French film-makers, Italian textile manufacturers, Bavarian smallholders and so on.
Still, we are where we are. A key task for Conservative MEPs over the next six months will be to try to convince others that free trade benefits all participants. For once, the word “convince” may be apt. Politicians rarely change their minds (as opposed to changing their policies, which they do frequently). Trade, unusually, is an example of an issue where intelligent people, shown the evidence, often do shift their view.
The reason is that free trade is literally counterintuitive. It seems to violate so many ideas that feel right. How can it be better to fly stuff half way around the world than to produce it locally? How can it be right to rely on one sector instead of encouraging the growth of a balanced economy? Doesn’t it make sense to shield infant industries from competition until they’re strong enough to go it alone? Shouldn’t we aim to be self-sufficient in basics, such as food?
All these ideas appeal to minds evolved on the savannahs of Pleistocene Africa. Our brains are designed to make short-cuts, to go with hunches. But the hunches that served well enough for hunter-gatherers programmed to hoard against famine are often irrational. (I try to address the food security issue, for example, in this blog).
Just as we can understand that an optical illusion isn’t what it seems, so we see through false intuitions (of which, indeed, optical illusions are a sub-category). A good example is the question of comparative advantage, perhaps the single most counter-intuitive notion in the whole of economics. If Country A is more efficient than Country B in every respect, we can see why Country A stands to gain from free commerce between the two. But surely, we assume, Country A’s gain will be Country B’s loss? Country B’s industries will be overwhelmed by cheaper competition, its workers thrown onto the streets. Won’t they?
Well, try watching the video above. The logic is ineluctable. Free trade makes all its participants wealthier. Some individual firms may lose, but the participating countries as a whole are, always and everywhere, better off. Indeed, the more efficient your trading partner becomes, the wealthier you get – even if your own productivity doesn't improve one jot.
You might contend, of course, that MEPs are too stupid to grasp the concept of comparative advantage. After all, if they understood economics, the euro crisis wouldn’t have happened. Well, maybe. But we don’t need to convince all of them; just enough to make the deal worthwhile. I’d say it’s worth a go, wouldn’t you?

The shocking announcement that Microsoft is cutting 18,000 jobs is still sinking in. Most of those employees do not have a realistic chance of obtaining as good a job as the one they are losing.

In the United States, the number of engineering jobs has been sharply declining. In 2002 the number of electrical engineering jobs in the United States was 385,000, but despite increased demand for technology, the job total dropped to only 300,000 last year.
And that number is not even for American workers, because thousands of these jobs are soaked up by the H-1B visa racket, whereby companies like Microsoft can import and pay foreign workers less than it costs to hire an American. High-tech companies have thousands of foreign employees working on H-1B visas, who are almost like indentured servants to the company because they lose their right to be in our country if they leave their job.
Microsoft’s massive layoff makes downright ridiculous the op-ed recently published by Bill Gates and his billionaire pals, Warren Buffett and Sheldon Adelson. They and Facebook’s Mark Zuckerberg, who financed the lobby group FWD.us, demand immediate amnesty disguised as immigration reform in order to bring in more cheap labor.
The real shortage is in good jobs, but these visas flood the labor market and hold wages down, when wages should be climbing for American workers. Fewer Americans have a job today than just six years ago, even though the potential workforce has expanded during that time. One reason is the overuse of foreign labor by large companies.
Microsoft is highly profitable, breaking its own records for revenue and profits as recently as last year, with an effective tax rate of less than 20 percent. One of its directors has agreed to pay $2 billion for a basketball team, and Bill Gates is often listed as the wealthiest man in the world.
In 2007, at a U.S. Senate committee hearing, Gates asked for permission to import "an infinite number" of foreign workers. "I don’t think there should be any limit," he continued, but at any rate the cap should be "dramatically increased."
In 2008, before the Science and Technology Committee of the U.S. House, Gates claimed he had jobs "going begging" that no American could be found to do, so he had no choice but to import workers from India. When Representative Dana Rohrabacher (R-CA) suggested he might consider raising the pay for those jobs, Gates impatiently dismissed that option, saying, "No, it's not an issue of raising wages. These jobs are very, very high paying jobs."
Economics 101 teaches that wages are a function of supply and demand. When the supply of labor is increased, such as by expanding immigration, then wages can and do decrease, despite increased productivity.
Recently a reporter caught up with the laid-off semiconductor engineer whose wife publicly challenged President Obama in January 2012, "Why does the government continue to issue and extend H-1B visas when there are tons of Americans just like my husband with no job?" Darin Wedel eventually found a job in the health care industry, earning $40,000-a-year less than before.
President Obama is still deceiving the American public about the economy, bragging that 288,000 jobs were created last month. As Mort Zuckerman explained in the Wall Street Journal, "Most people will have the impression that the 288,000 jobs created last month were full-time. Not so." They were part-time jobs, which pay lower wages than the full-time jobs that have disappeared.
There are several reasons for this, such as employers’ desire to avoid the Obamacare mandate to provide health insurance to anyone working 30 or more hours a week. Another is women’s willingness to accept lower pay in exchange for a flexible schedule with fewer hours per day, per week, and per year.
But now many breadwinners, including men, have been forced to take these jobs. Of men aged 25 to 54, one in six does not work; fifty years ago, only one in 20 was not working.
When we first brought the transformation of the American economy into a part-time worker society in 2010, many scoffed and suggested that when the ‘recovery’ really gets going the temp jobs will all be morphed into high-paying full-time jobs. Instead, Zuckerman writes, "more than 24 million Americans remain jobless, working part-time involuntarily or having left the workforce."
Zuckerman hits us with the depressing conclusion: "Faith in the American dream is eroding fast. The feeling is that the rules aren’t fair and the system has been rigged in favor of business and against the average person."
One Senator who always speaks up for Americans, Jeff Sessions of Alabama, said, "I don’t think you can make the argument that we have a labor shortage." The answer should be: close the border; absolutely no amnesty masquerading as "immigration reform."
